About these terms

This website is run by NancyCane, a series of NextCTR LLC ("NancyCane", "we", "us" or "our"). By visiting the site or buying from us you accept these terms, together with our Privacy Policy, Shipping Policy and Refund Policy. The shop is built on Shopify, which provides the platform the site and its checkout run on.

Using the site

To order from us you must have reached the age of majority where you live, and the details you give us must be accurate, current and complete. You agree not to use the site (a) for anything unlawful, (b) to infringe our rights or anyone else's, (c) to upload malicious code or interfere with how the site works, (d) to gather other people's personal information, or (e) to send spam, scrape content or pretend to be someone you are not.

Prices, tax and mistakes

Prices are shown in pounds sterling and may change without notice, although a change never affects an order you have already placed. Where tax is charged at checkout it is shown before you pay, and if customs duty, import VAT or a carrier handling fee is charged when a parcel arrives, it is payable by you. Now and then the site may carry a typo, an inaccuracy or an omission in a description, a price or a stock note; we may correct it and cancel an order it affects, refunding any payment in full.

Colour on screen

Product photos and descriptions aim to be accurate, but every screen and device shows colour a little differently, so the shade you see may differ slightly from the item itself.

Orders

An order is an offer to buy, and we may decline or cancel it before dispatch, for example when an item is unavailable or a price was shown wrongly, refunding any payment in full. We may limit how much of an item we sell to a person, household or region, and we may withdraw or discontinue any item at any time. You can change or cancel an order by email in the first 2 hours after placing it. By paying, you confirm you are authorised to use the payment method you choose.

Delivery and risk

Carriers and weather can cause delays, so delivery times are estimates rather than fixed dates, and we email you if an order runs late. While a parcel is in transit it remains our responsibility: if it is lost or damaged on the way, we start an inquiry with the carrier on your behalf and then send a replacement or a refund, whichever you prefer. Please report damage or a missing parcel within 7 days of delivery where you can, so that it can be dealt with sooner. The risk of loss passes to you once the parcel is in your hands, or with a person or safe place you have chosen to receive it. If delivery fails because the address was incorrect or incomplete, a fee for sending the parcel again may apply.

Returns and refunds

Returns, exchanges and refunds follow our Refund Policy. Nothing in these terms affects your statutory rights.

Our content and your feedback

The text, images, graphics and other content on this site belong to NancyCane or its licensors and are protected by copyright and other intellectual property laws; they may not be copied or reused without our written permission. If you send us suggestions, ideas or other feedback, you allow us to use, adapt and publish them without payment or credit to you.

Links and Shopify

The site may link to third party websites that we do not run. We are not responsible for their content, products or practices, and visiting them is at your own risk. Shopify supplies the technology behind the site and its checkout but is not a party to your purchase and is not responsible for the items we sell.

Our liability

The website and its services are provided "as is" and "as available", with no assurance that they will be uninterrupted or free of errors. This does not apply to the products you buy from us, which are covered by your rights under consumer protection law, and nothing in these terms limits those rights. We are not liable for indirect or consequential losses, or for losses that were not reasonably foreseeable when you placed your order.

Events outside our control

We are not responsible for a delay or a failure to perform that is caused by events outside our reasonable control, such as severe weather, strikes, carrier disruption or the failure of public networks.

Governing law

These terms are governed by the laws of the State of Texas. If you are a consumer in the United Kingdom, you keep the protection of the mandatory laws of the part of the UK where you live and may bring a claim in your local courts, and nothing in these terms affects your statutory rights.

Severability and changes

If any part of these terms is found to be unenforceable, the rest stays in force. We may update these terms by posting a new version on this page; the version in place when you order applies to that order, and continuing to use the site after a change means you accept the new version.
